First, you would do well to get criminal charges underway, if you feel that is necessary. A lawsuit is only as good as the depth of the pockets of the party being sued. Anger is not grounds for a lawsuit. Injury, damage, loss is. So be clear on your goals.

Any person can be sued at any reason. To prevail in a assault case, you must show that the other side's intent, apprehension of offensive or harmful touching, and damages.
