An eviction notice can be issued without a written lease. When the issue is non-payment of rent, the landlord is not required to give any notice. If it is an issue other than non-payment of rent, the landlord is required to issue a written Notice To Quit and Cease, before filing for eviction.

Yes, as long as you are renting from a person they can serve you at anytime with an eviction notice. They do not have the right to kick you out immediately but if they give you notice then it is allowed.
