Can yo give someone an eviction notice without a lease?

Can we fight the eviction notice?

Answer by  epglaw (553)

An eviction notice can be issued without a written lease. When the issue is non-payment of rent, the landlord is not required to give any notice. If it is an issue other than non-payment of rent, the landlord is required to issue a written Notice To Quit and Cease, before filing for eviction.

State laws vary as far as time frames, but a landlord can evict without a lease or rental agreement. The eviction notice should give you a specific amount of time to pay up the rent and any fees that you owe and you can avoid the eviction by becoming current. Contact your landlord directly and try to work it out.

You probably have to give someone an eviction notice legally even without a lease. So, the answer is yes, you can give someone an eviction notice without a lease. The eviction notice is based on how they pay the lease, weekly, bi-weekly, or monthly.

Generally a lease is not necessary, but eviction law and eviction processes vary from state to state. Contact the Sheriff's office in your jurisdiction for information on how to proceed.

Yes, as long as you are renting from a person they can serve you at anytime with an eviction notice. They do not have the right to kick you out immediately but if they give you notice then it is allowed.

If the eviction is based on non-payment of rent, then they must make efforts to collect before evicting. However, an eviction notice can be given regardless of having a lease.
