In the state of Arkansas, incarceration is grounds for requesting a divorce. As such, there is nothing to contest. Arkansas has several grounds for divorce that are clearly spelled out. There is a 30-day waiting period after filing before the case is heard by a judge. Matters of property, child custody and child support are addressed as needed.

The Petition for Dissolution of Marriage in Arkansas must declare the appropriate Arizona grounds for the dissolution of the marriage. The appropriate lawful ground will be that which the filing spouse want to prove to the court. Imprisonment is grounds for divorce in Arkansas. The divorce can be granted without the consent of the incarcerated spouse.

Every person has a right to defend themselves in a court of law. That is true even in a divorce case where the one party is an inmate.

Any divorce can be contested. These issues, contesting and being in jail, may just mean your divorce may take awhile longer. Contact your local family law office for advice on how to precede.
