Can an employer deposit your paycheck then withdraw it if they made a mistake?

I was overpaid by my employer and am concerned that they will take back my check.

Your employer can deposit your check if you have filled out very safe, particular direct deposit paperwork- after that it is YOURS! Your employer has NO access to your bank account, and if they do take any money out, they are committing a serious crime. You may be able, however to repay by small payments from your account.

The probably can't take your check out of your account, but they can ask you to give it back. Failing to do so might result in theft charges.

IF the employer overpaid you and you knowingly spend this money - then you are stealing from your employer. You absolutely have a duty to return this money and approach your employer about the money yourself. If they find the mistake they can take the money back, and probably fire you.
