With an order or protection, what if a victim goes to the defendant?

The order of protection still stands. The Judge may fine the victim for going against the injunction. The Defendant is not protected JUST BECAUSE the victim came to the defendant.

Read your order. It is very well possible the victim could be held in contempt of court and get in trouble. The order may be thrown out. If you want to dismiss your protective order you will have to file that with the courts.

The respondent should refuse the contact, report it to the police and the court. The respondent should insist that the petitioner go back to court and ask that the Order of Protection be dismissed before allowing any contact with the petitioner.

If the victim visits the defendant, the defendant is violating the order of protection, would could be seen as violating it. If the victim voluntarily violates the order, the defendant cannot be held guilty of violating the order of contact.

If the petitioner of such an order contacts the defendant, he or she can go to jail. If the defendant fails to notify police, they may be penalized too.
