Who is responsible for car payments after a divorce?

The person who keeps the car should be responsible for the car paymento as well as all costs associated with the upkeep of the car. This is fair because the person who does not use the car should not be stuck paying for the car.

Both ex-spouses are jointly responsible. However, it is common for the property division that occurs as part of the divorce to specify that one or the other must make the payments. Most often, the one who keeps the car assumes responsibility.

It depends on who has the car in their possession after the divorce. In most cases whoever gets the car will have to pay the payments on it. It's as simple as that. You are the one driving the car around so why should your spouse have to pay for it??

In terms of the divorce decree, the liabilities would also be decided by the court giving judgement about the divorce when they are deciding about the assets sharing and the car payments would have to be paid accordingly by that party.
