You will need to get the Uniform Custody paper work filled out and notarized stating whom has the children to turn in with the agreement. Make sure to include support.

If you want a legal separation, spell it out with the help of an attorney. Include the amount of child support and maintenance to be paid, rules regarding access to the house, the sale of assets, access to bank accounts, etc. Sit down and make a list of all possible concerns, however remote they may seem at the time.

This should include all of the main points of a divorce, who has what property, is there any maintenance paid (alimony), how you will care for the children etc.
