What is the equitable tolling doctrine?

I need to determine if the equitable tolling of doctrine can assist me with my case.

The equitable tolling doctrine lets the court toll a statute of limitations when there are extraordinary circumstances that make it unfair to apply such a statue as writen.

Equitable tolling allows the court to set aside a statute of limitations if the damage/injury was not known until after the SOL has expired. It is rare that this happens.

This doctrine states that the court is able to set forth a statute of limitations if if the S.O.L document was expired but the damage was not known. Hope that helps.

It is basically meaning that you can have a fair chance and whatever. This law is used by any supreme court. I believe depending on the extremity of your case, it can help you out. It can only be used in rule 32 cases if you may be aware of this fact.

It is the idea that the plaintiff should still be able to bring a claim even if the statute of limitations has run if it is equitable to do so.

"Equitable tolling" is the principle that says in a tort case, the statute of limitations need not apply if the plaintiff could not discover the injury within the SOL timeframe.
