What is the car driver's liability if he hits a cow?

Is it the driver's fault?

Not the driver's fault. The owner of the cow is liable for the damages because the owner of the cow had a responsibility to keep the cow out of the roadway. The owner of the cow could sue the driver but would probably be unsuccessful.

The owner of the car who hit the cow is not liable, whoever owns the cow is responsible for it getting loose.

If a driver hits a cow, it would be accessed under the same theory of liability of a regular auto accident. If the cow escaped through the fault of its owner, that owner may be liable to the driver for any damages and injuries sustained.

The car driver would likely have to compensate the owner of the cow for the value of the cow. There is no question that the driver is at fault in an instance like this.
