However sometimes the crime is so heinous the prosecutors ignore age and attempt to charge the individual with special circumstances regardless of the age. That is why there are young people under eighteen serving life imprisonment with no chance of parole.

In Texas, individuals as young as 14 years of age can be certified and tried as adults. The District Attorney will file the petition to certify.
