What happens if I'm a passenger in a vehicle with drugs in it?

Could I be some sort of accessory if I didn't know?

In order to be an accessory, you have to knowingly encourage or assist in a crime. You shouldn't be charged as an accessory unless you had reason to know.

Unless proven without a doubt, more than likely any passenger will be involved in an arrest with the others who are carrying drugs in a vehicle. Many times it is difficult for officers to come to the conclusion that others honestly did not know that drugs were present. For this, mandatory laws in most states have been put into place.

Chances are, who ever had the drugs in the vehicle does not fess up to having possession, they will take everybody in the vehicle to jail and charge them with possession of a controled substance.

There will be a through investigation and honestly it depends on the circumstances. The officers feel like if you know the driver well enough to be in the car with him, you would know about illegal substances in the vehicle. The charges would depend on what and how much was found. Really its up to the arresting officer.

Even if you are a passenger you are most likely to get arrested too. I would make sure to telly our friend to keep his drugs at home.

if your in a car with drugs in it you can be considered a accessory because they would think you were lying about not knowing the drugs were there in the first place
