A battered wife is protected by the laws that provide for the arrest and possible incarceration of the abuser. Protective orders are also a resource.

The law of battery, just means that someone is hit or "battered". It usually includes assault or "put in fear". It is a misdeamenor. Get an injunction.

If you are being battered and need to get out, especially if you have children, there should be some sort of safe house in every state. You can look online or call the police dept. for information. If your being hurt, call them, they will help. You need to leave.

You need to file a police report. They will investigate and probably file a restraining order. Then you will have to decide if you want to prosicute him.
