What can I do about my ex who wants to take my kids out of state?

It is not in our custody agreement but I don't want them to go out of state with him.

If you are concerned with their safety you can file an emergency petition with the court to try to keep the kids in the state.

In joint custody, he cannot take the children to a location that impedes your ability to seem them as agreed. He also cannot create a situation that interferes with your regular visitation. If he has full custody, he must then assume all expenses to guarantee your visitation. See an attorney.

You can file another petition for that particular issue only in the same Court if possible, since it is not included in your custody agreement. Be sure to have the signature of your husband in the agreement.

You need to request a modification to your custody agreement or have a judge order him to keep them in state. If he is not the custodial parent, i. e. you either have true joint custody or you have full custody he cannot remove them from the state. You need to speak to a lawyer and go before a judge.

In the majority of states it is against the law for a mother/father to take their children out of state without the courts approval. Consult your attorney for sure.

If you have proof of potential risk to the children, such as emails threatening harm, you can file an emergency petition with the court to prevent it.
