"Spousal rights" refers to the rights of the two parties who are married. These rights pertain primarily to the assets of the marriage and can vary, depending on state law. Some spousal rights include social security benefits, the right to file a joint bankruptcy, the right to file a joint tax return, etc.

Nowadays this is a legal term to adjudicate financial rights. However, some abusers use the term to abuse their spouse by claiming that a spouse "owes" them sexual favors- this, in itself, is a heads up to GET OUT. There's no law by which a spouse can claim "rights" and force you to have marital sex. That's abuse and rape.

I think it depends on the state you are in. You really should consult a lawyer to find out. The lawyer can tell you what you need to do. They can tell you what rights a spouse has in your state. The lawyer can tell you everything you want to know.
