Trade names, brand names, trademarks and related matters are governed by federal, not state, law. If a trade name is registered, branded and or trademarked, it is against the law for anyone else to use it without expressed permission of the holder of the rights.

No trade name needs to be registered when the trade name is the surname of the person or persons owning the business. If a unique trade name is to be registered than a verified statement(trade name form) must be recorded with the county recorder.
