Is it illegal for a company to do a background check on you if you are not eligible for the job?

Nope. It's perfectly legal. It has nothing to do with eligibility in most cases. It has to do with criminal records. Most companies don't like to hire people who have felonies or are sex offenders. Some also don't like people who have stolen in their pasts. They don't want anyone who is a risk to the company.

It is not illegal because when you filled out the job application you completed the form giving them permission to do the check. Although you may not be eligible for that job they may keep your application on file and consider you for another position that may eventually open up.

Background checks can be done on anyone as long as they do not violate privacy laws and access information legally required to have clearance to access (i. e. bank records, etc. ).

For my opinion is a big Yes, since I'm not be with their company, they don't have the right keep my records, etc.

If you apply for a job and agree to a back ground check as a pre-condition for employment, then they can do a background check on you. They may have deciding you were not eligible after doing the background check.
