Is forcing restaurant employees to tip out legal?

I'm thinking it should be voluntary.

It is not legal to force employees to tip out. Tips are the tipped employees property and it is up to the employee to decide if they tip out.

Some restaurants force their employees to tip out while others don't. Restaurant employees already earn low wages and therefore they shouldn't have to share the tips they earn with others. All restaurant employees have equal chances at earning their own tips.

There is nothing that says you cannot mandate your employees to tip out. However your employer is allowed to do this. In most places it's customary to tip out bus boys or other employees that help you get your job during the night. It sucks to have to give your well earned money but you couldn't do it without them.

As long as the total wages are above the federal minimum wage, this practice is perfectly legal. Indeed, it is not even all that uncommon.

Tips are the customer's private property. An employer has no right to govern the tips customer's have presented his employee. Employers cannot legally require that employees turn over the customer's tip to the control of employer unless the customer has consented.
