It depends on how extensive the damage is. If the floors are badly scratched up all over the place, then the best solution is usually to rent a special sander used to sand off the finish and smooth the surface. Then, you have a fresh slate to prepare and stain either a similar color or a completely different shade.

Sand the floor and get the old stain off. Restain the floor and poly the floor to your preference. Matte finish or semi gloss. A word of caution. Do this before you move into the house the sanding makes a big mess.
