There are different types of rights that can be reserved for a song that determine what kind of use is fair. ASCAP and BMI publish online databases of copyrighted works.

Public domain songs will usually either state that they are public domain. All music that is seventy five years old or older is public domain.

If they are not copyright protected then they are public. All of Beethoven and Mozart (anything before the 1900's) are public domain due to that there was no such thing as copyright back then.

Songs that are public domain are usually free on iTunes, stated to be publically free, or are at least 75 years old (most classical music.)

I usually go online and look for sites that host lists of public domain songs, just to make sure that it is in fact public domain.
