How do they calculate alimony?

Each state has different laws on how it's calculated. Some of the factors are length of marriage, income of spouse, and your own income. Some states have a cap on the monthly amount, others don't. Same for the length of alimony. It will all depend on where you live, how much your lawyer can negotiate, and what the judge decides.

Each state has their own procedures, but for the most part alimony is not "calculated" so much as "decided". If the Court determines that you can pay, and that the other party needs to be paid, then an alimony order will issue.

Alimony can be calculated based on how long the marriage was, what assets were accumulated, the level of income received, were there any children produced during the marriage (child support) and capital gains, such as stocks, bonds or CDs. There is no one way to determine alimony, which is why both parties meet in court in front of a judge.

There is no set formula for calculating alimony, as it is based on a case by case basis, and the legal procedures of the state in which one lives. And it may be on a temporary basis.

There is no formula for calculating alimony. Judges take several things into consideration including the length of the marriage, number of children and the ability of the spouse to pay.

What if the paying spouse is an independent contractor (works for just tips) and doesn't claim on taxes nearly as much as he makes? He makes triple what his spouse makes at her job.  add a comment
