You are permitted to purchase property in Texas that is in a flood plain. How are you are permitted to develop this land, i. e build structures, is based upon local law. Many recommend consulting flood maps to see if the land in question is located within the 100-year flood zone before making a purchase to better assess the risks involved.

The Federal Emergency Management Agency (FEMA) tracks flood plain information. The FEMA Map Service Center website lets you search for a particular address and see the flood zone map for that area. If your property doesn't have a street address, choose an address nearby to search. You can also zoom in to your location in a Map Search.

Every county in the state has a planning board and Transportation and Natural Resources department, both of which have flood plain maps available to the public. You can request these maps to determine if the property is legally in a flood plain, and thus would be required to have flood insurance.

FEMA has access to all of the flood plain maps. You can search any area before you buy. You generally are allowed to buy property but building on the property if it is in a flood plain can be limited. The years of the floor plain also make a difference such as 50 year flood zone.

The easiest way to find out if your property is in a flood plain is to ask a local insurance agent. He has the maps to show you exactly where you stand and can offer you the appropriate insurance if necessary.
