Can my neighbor cut down plants that are on my side of the fence?

The neighbor cannot come onto your property to cut down plants. The neighbor can request that you cut back plants and trees that originate on your property and then extend onto his property over the fence or under it. Failing that, he has the right to trim the plants back himself.

If your plants encroach on their side of the property then can consider that part only as theirs. Then they can legally cut down that portion only. The way to get around it is to make sure you trim all that is on their side. Also try and become friendly with them and ask for permission to trim it.

If your plants create a nuisance they can cut down on THEIR side, which may create a problem with your plantings. It is really best to be the "big person" in a case like this, offer your good right hand and work it out. Plants die, neighbors stick around.

Your neighbor does not have the right to do anything on your side of the fence. The plants on your side are your property. Legally you have the right to complain, but this is something that you two should work out privately between you.
