Can my boyfriend claim "head of the household" if I have no income?

"Head of household" is reserved for the individual who supports dependents in the household. This includes, kids, elderly parents, spouse, etc. You are not his dependent, legally.

You have to very careful about this. If children are involved, no, he can't as there is no blood relationship. He may or may not be able to claim you, but under very precise strictures. He may be able to claim maintenance, but you need to consult a tax specialist.

He can as long as you let him claim you as a dependent. If he is taking care of more than 50% of your needs then he can.

Head of Household is a filing status given to those who provide more than half of all living expenses and pay for the home of a child dependent. The IRS tax code does contain quite a few exceptions, but I would say no unless he is claiming you as a dependent also.
