real estate

Question by  misty2009 (19)

Can I get out of selling my house after the Realtor has found a buyer?

I have a good offer on my home, however circumstances are so that we do not need to move now, I have not accepted the offer but the real estate agent is trying to force me to do so.

If you have agreed to a final contract and signed, then you can be sued for "specific performance" by the buyer and possibly forced to leave. If not, your agent may sue you for commission due under the listing agreement if they brought a qualified buyer and you refuse them.

Unless you have signed the papers and have gone past the three day right of recision time frame no one can force you to move from your home. Just tell the realtor you have changed your mind and to quit bothering you or you will file a complaint.

You can decide not to sell your home, however, the agent has completed the contractual obligation upon bringing you an eligible buyer. Therefore, the agent can't force you to sign but you could be forced to pay the agent's commission under the laws of your state whether you actually sell the home or not.

You do not have to sell your home unless the offer is full price with no contingencies. You need to tell your Realtor that you are taking your house off the market and possibly pay her for advertising expenses.

If you have not signed the contract to sell, you are not under obligation to do so. Remember that the agent only gets paid upon sale so is eager to make a sale. The refusal to sell is the same if you refused a low bid. It's your choice.
