Can a debt collector get someone to issue a bench warrant?

A bench warrant is issued by a judge and demands that someone voluntarily appear in court to face charges or face arrest to be brought to court. In debt collection cases, these are usually not issued... and when they are, it's usually when a case is in the post-judgment phase.

No, a debt collector can not issue a bench warrant. However, debtscollectors try a variety of intimidation tatics in order to recieve a payment because their paycheck depends on your paymetns. Threatening such action or any action against your family, pets, children is also illegal and against the Fair Debt Collection Act.

No. In a civil case, like debt collection, they wouldn't issue a warrant, but simply enter a default judgment if you fail to show for court.

Only a judge can issue a bench warrant, and then only for failing to obey a subpoena or criminal misconduct. You cannot go to jail or be arrested for any debt, and it is illegal for a debt collector to threaten you with this. You should speak to a lawyer as soon as possible; you may be entitled to damages.
