Answer by  Newbie (54)

It is hard to imagine what individual right is invaded by the effective supervision of traffic and the enforcement of speed limits and other operational rules. Improper use of the camera otherwise than for traffic control or misuse of the information obtained might wrongfully compromise an individual's right to privacy.

This case has been made numerous times and has consistently been denied in the courts. As long as the traffic camera is not taking photographs of you in your private dwelling or other personally owned place with assumed privacy it is not an invasion of your privacy or rights.

Traffic cameras as no more an "invasion" of one's "rights" than the police officer who clocks you with a radar gun. What rights are affected by a traffic camera?

I am not sure that the Court has ruled on this matter, but I would bet that it will in the future and find that it is not a privcy violation. Traffic movement is a public issue requiring state management. Also you have no expectency of privcy in the public

Most courts have ruled that traffic cameras do not violate anyone's rights because drivers should have no expectation of privacy when they are in their cars.

Traffic cameras have been help up as legal in most states. It is illegal if the traffic camera is installed and then yellow lights are shortened to generate "revenues" at the expense of driver safety. They are illegal if used to follow citizens' activities outside of driving offenses. They are illegal if set to spy on residences.

This depends on who you talk to. However, because they do not generally reveal much beyond the make, model, and license plate number of a car, they are not a violation.
