Music enters public domain seventy years after the author's death. So many traditional Christmas carols are legal, however if it is a more contemporary piece, then it is more than likely copyrighted.

no it is not legal, depends from which site are downloaded, but everybody is downloading from torrents and rapidshare> nobody ged punishd for that yet
