This can constitute a felony, since if the check was written and cashed, then forgery and fraud has been committed, as well as theft of the funds, misrepresentation and possibly false utterance. Felonies can be punishable by more than a year in jail, or the judge may order probation and restitution. This will depend on severity, criminal record and jurisdiction.

Theft of someone's check is classified as "theft of a monatary device" the same as a credit card. If you cash the check you can be charged with fraud, the severity depends on the amount the check is worth.

If you wrote the check you may be prosecuted for check fraud. If you however just stole the check and did not cash it you will be charged with theft.

Alot of it depends what kind of check it was, and if it was cashed. If it was cashed it can range from probation to jail time.
