What are the laws regarding terminating employment?

Any employer can terminate an employee at any time for any reason. Severance is a negotiating tool, not an entitlement. No employer is required to pay severance.

In general, an employer can terminate an employee without offering severance pay, unless there is an employment contract or union agreement stating otherwise. Each state is different, so check with the Attorney General's website for your state or with the federal Department of Labor for their payday laws.

If you have been fired, talk to an attorney who specializes in wrongful terminaton. A good source for information is Department of Labor and Industry, in your state. In most cases, unless you have a written contract, you are doomed. Employers have to pay you, what you are owed. Severence pay is not required, unless there is a contract.

You are only entitled to severance pay upon termination if the contract that you signed upon your hire stipulated that there was a severance package. If you are planning to leave a job, speak to your Human Resources department and ask about severance for your position.
