It depends on how the company has set up its policies for hourly v. salary employees, some of whom may be exempt or non-exempt.

A salary is agreed upon by the employer and employee, as are related conditions, like whether the employee is exempt or non-exempt, which amount to a contract. The government does not make laws with regard to salaries, job descriptions, hours, etc.

You have the right to overtime pay. You have the right for minimum wage pay. If there are teenagers under the age of 18 working, they cannot work past 8'oclock. You cannot be locked into a facility if you're working third shift. You have the right to assemble a union.

Your employer must legally post in the work place laws that effect you. If you are hourly and not in agriculture or food service must pay minimum wage, must pay over time over 40 hours, and must provide a set number of breaks based on the number of hours worked in a shift
