"Gruber" is a surname and as such cannot be restricted as to its use. A specific business name, like "Gruber's Fabulous Fries" could be trademarked, thus prohibiting another company from using "Gruber's Fabulous Fries," but any Gruber family anywhere could open a restaurant or market or boutique and call it "Gruber's."

There is no limit to the number of business that can be named Gruber's. In certain circumstances companies will file trade name protection.
