How do you settle a claim for emotional distress?

Someone is suing me for emotional distress, I would like to offer them a settlement but do not know where to begin.

First of all, find out if your state allows payment for emotional distress, and if so, what that definition is. Google "emotional distress" AND your state for info.

Unless you really feel you can be convicted as transgressed, I certainly would not settle. Emotional distress is loaded with gray areas, and usually dismissed by courts unless accompanied by tangible offenses such as assault, etc. You would be foolish to settle without benefit of counsel.

If the plaintiff is represented by an attorney, you can contact the attorney by letter or phone if not contact them directly.
