How do you file for a quick claim deed in the state of Texas after a divorce?

I recently got divorced and was awarded the family home.

Take your divorce decree to the county deed office in the county where the home is located and apply for a quick claim deed. These often have a financial fee and you have to do it soon after the home is turned over to you.

One thing to check into, is if there is still a mortgage on the home you both may still be held responsible for the payments even though the home was awarded to you through the courts. Usually you have to refinancing will solve the issue of removing the other party. But be on the safe side and consult a lawyer.

It's called a Quit Claim and your lawyer should help you with this. One thing to check into, if there is still a mortgage on the home you are both still held responsible for the payments even though the judge awarded it to you. Usually you have to refinance to remove one party.

The person giving the property is the grantor, the one receiving is the grantee. Usually only the grantor and not the grantee sign the Quitclaim deed. Sign and notarize it. Take it to County Recorder's Office. Record it and give a copy to the grantee, grantor, and title insurance company.

Note that if you file a quick claim deed, it does not change the mortgage on the house as being in both names. Do not change the deed until you have a new mortgage; you risk losing the house because he refused to pay toward the mortgage or is slow paying on other joint debts.
