Depending on your state, you file a law suit to stop the building on the encroached land. In that law suit you ask for both temporary and permanent injunctive relief. The temporary relief stops the building while the law suit is pending. The permanent injuction is the ultimate relief you are requesting in the law suit.

A court can grant an injunction and this can be done in a civil context. You must file an application with the court. An injunction is a remedy to the tort of trespass and thus is only something you can request. The court will grant one based on the effectiveness of your argument and veracity of evidence to support claim

You must request an injunction from a state equity court and alllege and prove that the pending construction is irreparably harming your rights as an adjacent landowner.

In order to file an injunction to stop a contruction project that is being built on encroached land, one should prepare a complaint for injunctive relief that needs to be filed in the county where the encroached land is. The complaint must set forth the reasons for the injunction and show that it will cause immediate harm to one's rights.
