What can be done about an unauthorized tubal ligation procedure?

An individual signs to authorize this procedure. A guardian can sign on behalf of a woman who is deemed incompetent by the court. Physicians do not do "unauthorized" procedures. A tubal ligation done by accident is subject to a medical malpractice action.

ive consulted lawyers . ive played that day bac in my head for seven years i didnt sign anything to my contious knowlege. before i was druged. i said no to my delivery doctor and the nurses. it seem the statue of limitation has ran out  add a comment

when i was five or six months i mentioned to my doctor my husband breathes on me i get pregnant he said who ever wants anymore kids should have the procedure he didnt want anymore kids so he had it done and said if i sign the day i reconsider  add a comment

Physicians do not perform "unauthorized" surgical procedures. This procedure was either authorized by someone or was done by mistake, which is different than being "unauthorized." For clarification, speak to an attorney who specializes in medical malpractice.

almost seven years ago i had my little girl, after giving birth three nurses came in to suggest tubaligation i refused. another nurse came in with a niddle to put in my iv next thing i woke up in unbareable pain not knowing why.  add a comment

Any unauthorized medical procedure (unless carried out in an emergency situation) should be investigated as a medical malpractice claim. Consult an attorney to decide if this option is right.

The victim may sue civilly for multiple torts including battery, intentional infliction of emotional distress or malpractice. The victim may also file criminal charges with the state.

You can file a complaint in state court seeking damages for physical injury; and for pain and suffering and emotional distress.

I would think plenty! I would go see a lawyer YESTERDAY because any operation has to be authorized by the patient if for no other reason, in case something went wrong. Suppose you would have died or had serious complications? It sounds like the surgeon needs to start explaining himself now.

Physicians in the US are not in the habit of performing "unauthorized" procedures. See an attorney and take along appropriate documentation to support your claim that this has occurred.

If you feel that a medical operation was done without your permission you have the right to sue for malpractice. However you have to make sure this was deliberate and not a decision the surgeon made to save your life.

If you are married, your spouse could have authorized it while you were unconcious. Find out whose authorization was given to perform it. If it was done by the doctor without your consent, you can sue.

Legally, your spouse CANNOT sign. My OB convinced my husband to sign while I was unconscious. She thought I should not get pregnant again. I sued and WON.  add a comment

You can file a civil suit over this. I would recommend that you talk to a lawyer about your options. It could maybe also be criminal.

Well that depends on whether it was life of death. If you weren't you can take the person who did it to court. Life of death sorry you can't.

The TL procedure itself is NOT life or death. You can always have it done at another date. My OB got my husband to sign and I sued and won.  add a comment
