A faxed contract is binding as long as it was signed by both parties and there was a "meeting of the minds" as to the terms and conditions.

A faxed contract is binding if both parties acknowledge that they signed it in sane mind. If a party denies signing it, it may not be upheld by a court.

If both parties have signed it, especially if witnessed, then the contract is binding in most cases. If the contract requires notarization and hasn't been notarized yet, it's not complete.
