There is no federal law regarding an unpaid leave of absence. The matter is between employer and employee. Each employer has the right to extend leave-without-pay or not.

There is no federal law for unpaid leave of absence unless it is damages in a federal lawsuit. Unpaid leave of absence damages would be in state law.
