In virtually every jurisdiction, burglary is a felony. Burglary, however, is an unauthorized entry with the intent to commit a crime. Simple trespassing is usually not a felony.

The unlawful entry of a structure/building/home to commit a felony or theft is burglary, aka a break-in or B&E. There are different degrees of burglary, depending on the circumstances, which vary from one jurisdiction to another. A weapon is not necessary to constitute a felony.

Burgary is a felony which carries a stiff penalty in all states, though the penalties do vary from state to state. The penalties associated with the crime of burglary are much worse if the crime is committed while the assailant is armed with a firearm or other weapon. This is true for both a crime committed and one attempted.
