An individual must be of age and have the means to support himself/herself in order to gain custody of a minor. Unless the minor is a ward of the state and has no parent or court-appointed guardian, it may be difficult to get custody.

Traditionally you need to be at least 18 years of age and in a stable condition. If you are emancipated they may consider someone as young as 16 but the requirements are very strict. You must have a job, a home, and be able to feasibly provide for the child.

You need to be of age to gain custody of a family member. This is not the only requirement to gain custody. You will need to also prove you have a good pay job, and a supportive stable living conditions, and the ability to emotionally and mentally support the child in custody.
