The Family Court hears custody matters and makes the final ruling. The party seeking custody files a motion to be heard and then schedules a hearing date. All parties are notified and expected to be present. Both sides will present a case for custody, which often focuses on why the other party is not fit.

You will not want to begin this process without competent legal representation. The right attorney will begin by filing a request for custody through the family court that has jurisdiction over your area of residence. A hearing of the facts of your case by a family court judge will determine custody.
