The exact procedures vary from state to state. In most states, there is a presumption in favor of joint custody. Parents are also usually encouraged to reach a settlement, if possible. Otherwise, each side presents their evidence, an expert who has interviewed the children often testifies, and the judge decides.

Once in court if parties are not in agreement to sharing custody or for all the details as far as child support and sharing holidays then the judge will give suggestions and help map out a plan that everyone will be happy with.
