At most employers, they owe unused vacation if it has already accrued. At many firms, unused but earned sick days should also be paid to you in your last pay check. If you earned it, they must pay it. The only exception is if you are not yet vested with vacation and benefits.

Check with your state and your employee contract but you should contact your previous employer about your unpaid vacation. If you accrued the time they must pay you for it. You will not be paid by the state or federal government for vacation time that was negotiated between you and your previous employer.

Unemployment laws vary state by state, but typically you will not receive state compensation for unused vacation. You will have a period of time that you can collect benefits.

The best thing to do is contact your state labor board and file a complaint. You will not get anything from unemployment for it.
