Who pays the mortgage during a separation?

Well I guess that would depend on which state you live in. When I was getting my divorce the first time my husband kept the condo and he had to pay the mortgage as he was living there not me. So best thing to do is ask a lawyer.

If a couple is separated but not divorced yet, both parties should agree upon who pays the mortgage. Ultimately, if the person who is staying in the house, wants to keep the house, they should make sure the mortgage gets paid no matter what.

Whoever payed the mortgage during the marriage usually continues to pay during a separation. Unless the person gives up on both his/her marriage and his/her rights to house, it's important the person keeps paying to show they provide support. The court may see not paying the mortgage as abandonment.

If both names are on the paperworth both parties would be responsible unless one signs off their responsibility. Also a seperation agreement could be made making one person pay or both.
