Normally the state or county you are living in has jurisdiction in divorce cases. However, if the spouses are living in different states it would depend on who files first.

The state courts have jurisdiction in divorce cases (as opposed to federal courts). Within the state court system, there are several branches. In the case of divorce cases, the branch that has jurisdiction is the family court branch. Family courts deal with issues dealing with marriage and children, especially when it comes to divorce.

Thus, it gets even more complex if the divorcing pair now live in different states; it is not unusual for multiple states to have jurisdiction. Usually, it is either the place where either party now lives or the place where they lived as a married couple.

Some areas have separate divorce courts, where they only hear divorce cases. Some areas have family courts that also take divorce cases along with custody and foster care cases. Couples can select mediators to help settle a divorce case, but the actual divorce papers still have to be filed with the family court.

Divorces are handled in most states in divorce courts, though some states handle it in family court. Cases not settled by remediation can go before a judge for decisions on child custody, liquidation and disposition of assets, and division of assets or property. Child support, though, has guidelines set by the state that are not negotiable.
