Who can serve a criminal subpoena?

The court hires appropriate subpoena servers. Generally, criminal subpoenas are served by armed law enforcement officials, for obvious reasons. While an individual in civilian clothes might serve a criminal subpoena, it is likely that the individual is armed and may even have a background in law enforcement. These measures would be for the safety of the server, not a requirement.

Usually, a subpoena can be served by anyone who is above the age of 18 years and of sound mind and body. Some jurisdictions allow service of criminal subpoenas by certified mail and do not require service by an actual person. I would suggest that you contact the clerk of court in your county to find out more.

Only an officer of the court, a sheriff, police officer or duly sworn individual can serve a criminal subpoena. If you receive one from someone like a landlord purporting to serve you, you should go to the court immediately and question it.
