What should I do about a week smoking tenant?

You can start my making a police report, then notifying the tenants that if they do not cease and desist you will be starting eviction proceedings. Aften you give them a reasonable time, what ever your state requires you can then go to housing court, with the police reports you should have enough evidence to evict.

If you know for certain that your tenant is smoking marijuana, notify him/her in writing that you are aware (and why) and that it is disturbing others. Threaten to notify the police if it continues, and do so. You can't take the law into your own hands and evict him/her because it is not your place to enforce the law.

Did you mean a weed smoking tenant? If that is your question then there is nothing you can do unless you had specifically stated in the lease you were seeking a non smoker. If you did not then he has the right to smoke there.

If your tenant is smoking pot in your property you can call the cops and legally evict him. I would kick him out, his habit could get you in trouble.
