Guardianship is a relationship that is created when a person named in a will or assigned by a Judge may care for minors or adults who are incompetent. The term custody is the rights of a parent to have their children live with him/her. Custody is also used to refer to an individual who is detained by law enforcement.

In North Dakota a Guardian Ad Litem (GAL) is a court appointed advocate for the child's best interest, who doesn't need to be a lawyer, in matters of custody, child support and visitation.
