Factors for consideration include the cases involved (medical, auto), the amount being sought in the overall contract, and from what source the monies are sought. The range of fees is often calculated on the amount recovered, with lower fees being paid for great amounts recovered.

This all depends on the law firm that is hired. In most cases, however, subrogation attorneys usually work on contingency fee agreements. That means that they obtain a percentage of the amount recovered. This typically can be between 33 1/3 percent to 50 percent. Like most fees, these can negotiated.

According to legal ethics it is must the lawyer has to be paid 1/3 rd fee for subrogation. it depends upon the case and the amount you claim from the insurance company. Moreover it depends upon the injury caused i the accident. If your injury is very serious nature or it leads to perment disablity and you claim more from the company.
