Capital murder is usually not charged on someone who is younger than eighteen. However sometimes the crime is so heinous the prosecutors ignore age and attempt to charge the individual with special circumstances regardless of the age. That is why there are young people under eighteen serving life imprisonment with no chance of parole.

The court will decide on how the individual is to be tried. A number of factors are considered, including the kid's mental status, family history, criminal history and the nature of the crime itself. In Texas, individuals as young as 14 years of age can be certified and tried as adults. The District Attorney will file the petition to certify.
