Homestead laws vary from state to state, so you need to check the law for your particular state in order to know for sure. I general, however, they require that a person be living in a home that they own with the intent to remain there.

Each state has different Homestead Laws You need to research the law for the state you reside in. The best place is to search for your state Bar. In the state of Nevada the requirements are outlined below. Land with a dwelling house on it plus appurtenances, a condominium, a mobile home. A declaration of Homestead must be submitted.

It depends on which state you are in and each state has different homestead laws. The general principle is that everyone should have a homestead with legal rights and protections.

The only part of the country that is still open to the old homestead laws (you stake it and live there and it's yours) is in Alaska.
